1. Acceptance of terms

By accessing or using frosting.go2thehive.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users of the Service.

2. Description of service

The Service is a dashboard tool that connects to the CAKE Marketing platform via your CAKE API key. It provides affiliate performance reporting, conversion pixel management, campaign link generation, and SSL/cookie domain monitoring. The Service is intended for use by businesses operating affiliate networks on the CAKE platform.

Frosting is not affiliated with, endorsed by, or in any way officially connected to CAKE Marketing or its parent company.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent. By using the Service you represent and warrant that these conditions are met.

4. Your CAKE API key

To use the Service you must provide a valid CAKE API key. You are solely responsible for maintaining the confidentiality of your API key and for all activity that occurs through your connection to the Service. Your API key is used only to make requests to the CAKE API on your behalf during your session and is not stored on our servers.

You agree not to share your API key with unauthorized parties or use the Service in a way that violates your agreement with CAKE Marketing.

5. Acceptable use

You agree not to use the Service to:

· Violate any applicable law or regulation.

· Infringe the rights of any third party, including intellectual property rights.

· Interfere with or disrupt the integrity or performance of the Service.

· Attempt to gain unauthorized access to any part of the Service or its related systems.

· Use the Service in a manner that violates your agreement with CAKE Marketing or any advertiser or publisher on your network.

6. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.

7. Intellectual property

The Service and its original content, features, and functionality are and will remain the exclusive property of Frosting. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

We make no guarantee regarding the accuracy or completeness of data returned from the CAKE API, as that data is controlled entirely by CAKE Marketing and your own account configuration.

9. Limitation of liability

To the fullest extent permitted by law, Frosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Frosting and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to these terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is registered, without regard to its conflict of law provisions.
